SNV Netherlands Development Organisation (SNV) is a non-profit, international development organisation founded 53 years ago, and now operating in 28 countries in Africa, Asia and Latin America. SNV has been working in Vietnam since 1995, and currently has over 30 national and international staff. SNV Vietnam operates from a head office in Hanoi and projects in over 50 provinces in the country, including in the poorest and most remote areas.

SNV is in need of a legal advisor or company to support the organisation in relation to our work when the need arises.  We intend to sign a retainer contract for a period of three years.  

1. OBJECTIVE: To ensure compliance with the Government of Vietnam’s regulations on International NGOs, the Labour Law and other relevant laws and policies, SNV Vietnam is seeking for a consultant or company specialised on legal affairs to provide ad hoc advice when needed for operations in Vietnam.

2. SCOPE OF SERVICE: To provide legal advice and professional services in relation to SNV’s Administration manual, HR manual,  labour contracts, as well as potential labour or contractual disputes, based on the most updated Vietnamese Laws and regulations, considering SNV’s International NGO project office status.

- Human Resources:

• All types of contract: Staff Contracts, consultancy contracts, Agreements and others 
• Administration Manual and HR Manual
• Insurance obligation fulfilment, social and other insurance payments  
• Labour or contractual disputes brought by current or former contractors or employees or to be brought against current or former contractors or employees

- Financial component:

• Tax obligation fulfilment: Personal Income Tax and VAT

- Any other related areas aligned with points 1 and 2 that the consultant might consider.

3. DEADLINE for SUBMISSION and Application form

• Interested Consultants are invited to send their offers in English no later than 17.00 on 6^th April 2020
• Format of the Proposal: Please clearly separate the technical document from the financial offer:

Technical document should consider and indicate:

• Examples of  scopes of work for at least three different kinds of likely assignment (e.g. 1) Review HR Manual 2) Review labour contract or 3) Provide advice on dispute with a contractor) and relevant laws applicable to the assignment/ topic.
• The Human resources allocated for each type of assignment and the period of time each type of assignment would take
• Company profile and/or example CVs of consultants who would be assigned to each assignment

Financial offer should include the service cost indicating:

• Professional fee for each type of assignment, including justifications and how calculations will be made in each case
• Tax obligation (VAT if applicable)
• Any suggested retainer fee per year
• Any other fees necessary
