About the program:

ASEAN–Australia Counter Trafficking (ASEAN-ACT) continues Australia’s long running collaboration with ASEAN and its member states to end human trafficking in our region. The program will principally work on strengthening the justice sector response to human trafficking, while opening up new partnerships with allied government agencies, civil society and business. It will engage all 10 ASEAN Member States in some capacity and will continue national-level programming in Cambodia, Indonesia, Lao PDR, Myanmar, the Philippines, Thailand and Vietnam.

Program Outcomes

The overarching goal that ASEAN-ACT will contribute to is that ASEAN member states have effective justice systems that provide just punishment of traffickers and protect the rights of victims. Three end-of-program outcomes (EOPOs) together contribute to the achievement of this goal by 2028:

• EOPO1: ASEAN’s planning, monitoring and reporting of ACTIP implementation is increasingly effective and advances the protection of victim rights.
• EOPO2: ASEAN member state justice and related state agencies are increasingly capable of implementing their ACTIP obligations, in particular those that uphold victim rights.
• EOPO3: ASEAN member state justice and related state agencies’ policies and practices are influenced by relevant stakeholders and better aligned with ACTIP, especially in connection to victim rights obligations.

Overview

The Vietnam National Plan of Action on Anti-Human Trafficking (NPA) 2016-2020 concludes in 2020 and the Government of Vietnam is planning to develop a new plan for 2021-2025. ASEAN–ACT will engage a consultant to support the Vietnamese government led by the Ministry of Public Security (MPS) to develop the next phase of the NPA that aligns with the obligation in the ASEAN Convention Against Trafficking in Persons, Especially Women and Children (ACTIP).

The NPA will guide effective implementation of Vietnam’s counter trafficking in persons efforts by prioritizing strategies that incorporate gender sensitivity and victim-centred analysis and are aligned to ACTIP obligations. The NPA is an essential tool to outline the share government agency responsibilities and coordination of action to ensure a whole of government approach.

Objective

The objective of the Counter Trafficking Planning Consultant input is to support Vietnam in its development of a new comprehensive NPA for Vietnam for the period 2021 - 2025 which will be the framework for the strategic planning of government ministries in the area of counter trafficking in persons. Specially the Lead Consultant for NPA development will:

• Support the government’s multi-sectoral team led by MPS to assess the implementation of current NPA 2016-2020 and get inputs and recommendations for the development of the new NPA 2021-2025 from government stakeholders.
• In close consultation with MPS and related ministries and sectors, produce a time-bound National Plan on Anti Human Trafficking 2021-2025 aligned to ACTIP that prioritises short, medium and long-term activities, outlines specific targets, clarifies roles and responsibilities, provide a monitoring framework, is budgeted and focuses on victim rights and gender/social inclusion.
• In close coordination with ASEAN-ACT’s Inclusion and Victim Rights Director (IVRD), Justice Systems Director (JSD) and the Vietnam Country Team, provide technical inputs to incorporate gender sensitive and victim-centred approaches aligned with ACTIP’s obligations into the NPA 2021-2025.

Areas of Responsibility

Under the supervision of the Country Manager – Vietnam, JSD, IVRD, the Counter Trafficking Planning Consultant for NPA development in conjunction with the National Consultant - Support Vietnam National Plan of Action and the MPS led Multisectoral Drafting Team will be responsible for:

Review National Plan of Action on Counter Trafficking in Persons 2016-2020

• Collate information and resources to review of the current National Plan of Action on Counter Trafficking in Persons 2016-2020.
• Develop questionnaires to be given to government and non-government stakeholders to gather information to aid the assessment of the previous NPA.
• Aggregate the survey results on the implementation of the NPA 2016-2020 with information and data provided by the National Consultant to support Vietnam National Plan of Action on TIP to get inputs for new NPA development.

Develop National Plan of Action on Counter Trafficking in Persons 2021-2025

• Participate in and assist with facilitating an initial consultation workshop to gather inputs and ideas for the outline, direction and content for the new NPA 2021-2025.
• Working in conjunction with the National Consultant develop and draft the new NPA with an emphasis on ACTIP alignment, victim rights and gender/social inclusion.
• Identify any potential issues for implementation of the NPA 2021-2025 and propose measures to address these.
• Participate in and assist with facilitating a national consultation workshops to get inputs and recommendations for finalization of the NPA.
• Finalise the NPA 2021-2025 based on recommendations and feedback from the national consultation workshop and to ensure that the new NPA is aligned with ACTIP and integrates victim rights/social inclusion.

Expected Outputs

The Counter Trafficking Planning Consultant is expected to work in a team with the National Consultant to deliver the following outputs:

• A work plan outlining the agreed outputs, methodology and timeframe for deliverables
• Draft questionnaires for the assessment accepted by the drafting team and approved by ASEAN-ACT
• A draft format for the assessment report on the implementation of the NPA 2016-2020, for agreement
• An assessment report to ASEAN - ACT on the implementation of NPA 2016 - 2020, including its alignment to ACTIP, with specific attention given to victim rights and gender/social inclusion with recommendations gathered from stakeholders.
• Draft outline of the new NPA 2021-2025
• NPA draft for review at the national consultation workshops
• List of inputs and recommendations for the new NPA
• Final draft of the NPA for MPS to submit for approval.

Selection Criteria

Qualifications

• Post Graduate qualification (or equivalent advanced university degree) in Political Science, Social Science, International Relations, International Development, Law, Justice or relevant areas

Required skills and experience

• Proven success in supporting the development of clear, succinct strategies, policies and plans through participatory approaches
• Excellent knowledge and understanding on international and ASEAN legal framework and policies relevant to trafficking in persons
• Excellent knowledge on victim-centred approaches and gender sensitivity within trafficking in persons
• Good understanding of the Vietnamese justice and political systems.
• Ability to work with government/justice officials and local authorities in a sustainable, respectful and locally led manner
• An excellent understanding of trafficking in persons, labour migration and social issues within the ASEAN region.

Desirable:

• Prior experience in Vietnam will be highly regarded
• Knowledge and experience of Australian Government development programs and reporting requirements

Reporting Requirements

• The Counter Trafficking Planning Consultant will work closely with the National Consultant and report to Country Manager - Vietnam, providing regular updates and share expected deliverables. The Country Manager-Vietnam, the IVRD and JSD will provide technical support to the Consultant and address any requests by the Consultant within a reasonable timeframe
• At the beginning of the assignment, the Lead Consultant will work with the National Consultant to establish a work plan including schedule, methodology, timeframes for the completion of each expected deliverable in consultation with ASEAN-ACT team based on the draft timeline.
