Position Title: Consultancy to Analyse Migration, Business and Human Rights
(MBHR) Landscape in Viet Nam

1. BACKGROUND:
Established in 1951, the International Organization for Migration (IOM) is a related organization of the United Nations (UN), and as the leading UN agency in the field of migration, works closely with governmental, intergovernmental and non-governmental partners to promote humane and orderly migration for the benefit of all.
In 2017, IOM launched the Corporate Responsibility in Eliminating Slavery and Trafficking (CREST) programme to support businesses in upholding the human and labour rights of migrant workers in key sectors and migration corridors to achieve the United Nations (UN) Sustainable Development Goals (SDG) (particularly targets 8.7 and 10.7) and the Global Compact for Migration (GCM). Since 2017, IOM’s engagement with the private sector has evolved and grown to encompass partnerships and projects across a range of sectors including electronics, agriculture, food and beverage, health, apparel and footwear, fishing and hospitality, among others. Building on this workstream and engagements, IOM is launching a Migration, Business and Human Rights programme (MBHR) in Asia in line with the three pillars of the UN Guiding Principles of Business and Human Rights (UNGPs) of “Protect, Respect and Remedy”:

3. OBJECTIVES OF THE CONSULTANCY:
To inform the design of IOM’s MBHR interventions in Viet Nam and private sector engagement strategy in particular, IOM seeks to engage an experienced consultant to provide a comprehensive analysis of the MBHR landscape in Viet Nam. The assignment would include an analysis of national context and stakeholders concerning MBHR in Viet Nam, identify factors that contribute to driving private sector actions towards upholding the rights of Vietnamese migrant workers (internal and international migration), and provide strategic recommendations for IOM to promote Migration, Business and Human Rights agenda in Viet Nam through partnership with private sector.
The analyses and recommendations will cover both Vietnamese international migrant workers and Vietnamese internal migrant workers.
4. DELIVERABLES AND TIMEFRAME:
The selected consultant will work under the direct supervision of the CREST Project Manager, in close coordination with staff members of LMI Division in Viet Nam, and under the overall supervision of the Chief of Mission of IOM Viet Nam. The selected consultant will work on the following deliverables and timeframe:
First deliverable: context and stakeholder analysis: by 15 October 2023
Analysis of the country’s context on labour migration, protection of migrant workers, and business and human rights using the political, economic, social, technological, environmental, and legislative (PESTEL) analysis framework or other relevant framework for analysis.
Analysis of stakeholders concerning MBHR in Viet Nam, including their roles, mandates, and the inter-connection among them. This stakeholder analysis should also cover stakeholder ability/ power and willingness to influence private sector to take action towards respecting migrant worker rights, and to influence IOM’s programmatic objectives.
Second deliverable: factors driving private sector actions: by 25 October 2023
Identification and analysis of factors that contribute to driving private sector actions towards respecting the rights of Vietnamese migrant workers. This includes the identification of emerging trends and their (current and potential) impacts on Vietnamese businesses, risks and opportunities for private sector actors, existing interventions, innovative approaches and best practices.
Third deliverable: recommendations for IOM: by 6 November 2023
A set of strategic recommendations for IOM Viet Nam, in line with the IOM’s Theory of Change for MBHR Programme in Asia (to be shared), to drive private sector actions towards upholding the right of Vietnamese migrant workers.
