#009 - Job Title: A national consultant to provide consultancy services in technical support to Circular No. 41/2018/TT-BYT to promulgate National Technical Regulation and regulations on inspection and supervision of clean water quality used for domestic purposes

1. Background:

The Ministry of Health issued Circular No. 41/2018/TT-BYT promulgating the National Technical Regulation QCVN 01-1:2018/BYT and regulations on the inspection and supervision of domestic water quality on 14 December 2018 with 99 water quality parameters applicable to organizations and individuals performing part or all of the exploitation, production, transmission, wholesale and retail of clean water under a centralized system.

According to Clause 1, Article 35 of the Law on Standards and Technical Regulations, "the agency promulgating technical regulations shall review technical regulations every 05 years or sooner when necessary, from the date of promulgation". In 2023, the Ministry of Health reported about the implementation of the Circular No. 41/2018/TT-BYT and QCVN 01-1:2018/BYT in effect for 05 years in 63 provinces/cities. The report had reviewed the existence and problems in the process of implementing the Circular and QCVN 01-1:2018/BYT; difficulties in applying and complying clean water quality parameters regulated in QCVN 01-1:2018/BYT. The report showed the need to amend and supplement a number of articles of the Circular No. 41/2018/TT-BYT to suit the characteristics and actual situations in Viet Nam.

In this regard, Viet Nam Health Environment Management Agency (VIHEMA) requests WHO for continuing support to VIHEMA through hiring 01 national consultant to provide technical support to a new Circular by amending and supplementing a number of articles of the existing Circular No. 41/2018/TT-BYT of the Ministry of Health promulgating the National Technical Regulation and regulations on inspection and supervision of domestic water quality.

2. Planned timelines: Part-time

Start date: 22 May 2024 (subject to confirmation)
End date: 25 September 2024
Number of working days as a consultant: 40 non-consecutive days

3. Work to be performed

Purpose of the consultancy

To provide consultancy services in technical support to Circular No. 41/2018/TT-BYT to promulgate National Technical Regulation and regulations on inspection and supervision of clean water quality used for domestic purposes.

Method(s) to carry out the activity:

  • In general, 01 selected national consultant to be hired by WHO will carry out their work based on his or her ToR.
  • The selected national consultant will work closely with WHO Technical Officer in Environmental Health and VIHEMA focal points to conduct their work either in both policy/strategy and technical aspects to draft a Circular based on amending and supplementing a number of articles of the Circular No. 41/2018/TT-BYT for promulgating the National Technical Regulation and regulations on inspection and supervision of domestic water quality. The work of the consultant also is based on VIHEMA report on reviewing Circular No. 41/2018/TT-BYT in 2023 and comments/ recommendations and opinions from consultative workshops organized by VIHEMA in 2024

Outputs

Output 1: Report of desk study on the existing Circular No 41 and VIHEMA report on comments from all relevant stakeholders, reviewing and analysis of shortcomings and gaps and a plan for amending and supplementing the Circular in terms of both policy/strategy and technical aspects to be developed.

  • Deliverable 1.1: A desk study report on reviewing and analysis of the existing Circular No. 41 in terms of both policy and strategy and technical aspects in water quality technical regulation to be developed.
  • Deliverable 1.2: A plan for amending and supplementing the circular and the outline of the final report to be developed.

Output 2: A draft new Circular to be developed by amending and supplementing a number of articles of the Circular No. 41/2018/TT-BYT, in terms of both policy/strategy and technical aspects based on VIHEMA report on reviewing Circular No. 41/2018/TT-BYT in 2023 and consultative workshops.

  • Deliverable 2.1: Summary and analysis of comments and recommendations on the draft new Circular after amending and supplementing the Circular No. 41/2018/TT-BYT.
  • Deliverable 2.2: Finalized draft new Circular to be submitted to VIHEMA for approval.

4. Specific requirements

Educational Qualifications required

  • At least Master’s degree in public health, environmental health, environmental science or water supply and sanitation, analytical chemistry, chemistry or environmental engineering

Experience required

  • The consultant shall have 5-10 years of fulltime experience in dealing with public health, environmental health, environmental science or water supply and sanitation, dealing with drinking water quality, water surveillance and monitoring, water safety plan, analytical chemistry, chemistry or environmental engineering, development of water quality standards.
  • Experience in analytical chemistry, chemistry or environmental engineering or developing legal documents and drinking water quality standards.

Skills/Knowledge

  • Experience and skills in conducting WASH assessment, water safety plan, water supply and sanitation, analytical chemistry, chemistry or environmental engineering.
  • Experience and skills in developing legal documents.
  • Teamwork spirit, coordinating skills are needed for this post.

Languages and level required

Excellent in writing and speaking English. Fluency in Vietnamese as a mother tongue.

5. Place of assignment

The Consultant is required to work mainly at his/her own places in Hanoi.

6. Medical clearance

The selected Consultant will not be expected to provide a medical certificate of fitness for work.

7. Travel

The Consultant is not expected to travel.

8. Budget
